Guidelines for using the automated auction trading system

1) ZenMarket Proxy Shopping Service (run by ZenGroup Inc.) enables the User to bid and make purchases on Japanese auction websites. The User agrees to follow the Guidelines and Terms and Conditions of the ZenMarket service. The user understands and agrees with the fact that most of the auctions are for previously owned/used items and sellers are non-professionals. Therefore, the descriptions may be biased and not full.

2) Some auctions add 10% VAT tax to the final bid. 10% VAT is added to the winning bid, as soon as an auction ends. The User who won the auction is responsible for covering the VAT.

3) ZenMarket acts as a proxy for purchasing the products from auctions on User's behalf.
The responsibilities of ZenMarket include:
- Contacting the seller
- Paying for the goods
- Receiving the goods
- Storing the goods at warehouse for up to 90 days (60 days for free)
- Shipping the goods to the User

The responsibilities of ZenMarket do not include:
- Verifying and ensuring seller's trustworthiness
- Negotiating price
- Checking if the goods correspond with the description (see 15 and 17 below)
- Detailed verification of functions and reliability of the goods
- Domestic shipping of the goods from the seller to ZenMarket's warehouse (only goods that can be shipped by post or other delivery services can be purchased)
- Translating and explaining the manuals, instructions of use, descriptions of the items won on the auctions.

4) ZenMarket makes all efforts to settle any problems that may arise between the User and the seller. The User agrees not to shift the responsibility for biased descriptions made by sellers, any possible problems due to seller's dishonesty or lack of competence from the seller to ZenMarket.

5) The User is responsible for covering all expenses including, but not limited to item price, domestic and international shipping fees, consumption tax (if applicable).

6) The User is forbidden from bidding on illegal goods, goods prohibited for international shipping, goods that cannot be shipped due to size limits. The User is responsible for making sure the goods can be shipped to their destination. In the case of winning goods that cannot be shipped to the User, the User is responsible for covering all expenses in relation to said goods, including but not limited to the price of the goods, domestic shipping fees, service fees, and other expenses.

7) The highest bid the User can place on an auction equals User's balance minus ZenMarket’s commission of 500 JPY. The final amount due is calculated after the auction ends. The difference is reimbursed or charged to the User. Domestic shipping fee is calculated by the seller after the auction has been won and will be deducted from the User’s balance. If the cheapest shipping method comes without a tracking number and/or coverage for cases of loss or damage, for items over 50,000 yen we might ask the seller to use a more expensive one that includes tracking and/or coverage.

8) In the case the User's bid has been overbid, all expenses in relation to this particular auction are refunded to the User's balance. The User may increase the bid on his/her own discretion.

9) It is not possible to lower or cancel a bid once it has been placed. Once the User has placed the bid and won the auction, he or she is responsible to pay all the fees related to this auction, including but not limited to the good's price, shipping fees, consumption tax and any other possible expenses.

10) In case several items have been purchased from the same seller, ZenMarket’s automated auction trading system sends requests for combined shipping for items, purchased from 5 AM JST (Japanese Standard Time) until 4:59 AM of the next day. All the items purchased after 5 AM of the next day will be treated as purchased on the next day, and won't be eligible for combined shipping. ZenMarket is not responsible for cases when the seller refuses combined shipping or Yahoo! prevents ZenMarket's system from sending automated requests.

11) Due to technical reasons, ZenMarket cannot guarantee that all the information concerning the auctions is displayed online. Some delays may occur. We recommend bidding beforehand. ZenMarket is not responsible for losses or losses of profit caused by delays in updates of auction information.

12) If the User wants to cancel the order won on an auction at any stage, the price of the goods, ZenMarket commission, shipping fees and other expenses related to the auction will not be refunded. In addition, the User is responsible for covering recycling expenses of said goods and other possible expenses. The recycling expenses amount can be decided only by ZenMarket, depending on the size and other properties of the goods bought.

13) If the user has placed a bid and won an auction for goods that are prohibited for international shipping or cannot be shipped due to size limits, the price of the goods, ZenMarket commission, shipping fees and other expenses related to the auction will not be refunded. In addition, the User is responsible for covering recycling expenses and other possible expenses. The recycling expenses amount can be decided only by ZenMarket, depending on the size and other properties of the goods bought.

14) The seller can recall the goods from auctions or cancel the User's bids. ZenMarket is not responsible for such behavior of the seller. If the seller cancels the bid or the auction, ZenMarket provides a refund to the User, including the commission fee.

15) If the User applied for the "Item photos" option, the item purchased by the User is opened upon arrival and 3 or more photos of the goods are sent to the user. The user is responsible for checking the photos for inconsistencies with the item advertised.

16) If the User finds the goods that arrived at our warehouse do not correspond to the description of the goods on the auction page, ZenMarket will make all efforts to return the goods to the seller and get the User's money back. If ZenMarket is able to receive compensation from the seller, the money is deposited back to the User's balance. If the seller does not provide a refund, ZenMarket will not refund either. The shipping expenses are non-refundable.

17) If the User did not apply for the "Item photos" option, claims concerning goods bought from auctions will not be accepted.

18) By placing a bid, the User agrees to these Guidelines and confirms the following:
- the User places a bid on the items of their choice of sellers of their choice at their own discretion and assumes all the responsibility for the purchase;
- the User understands all the risks of buying products on auctions, including but not limited to cases of fraud, items not as described, counterfeit items.
- the User has checked the photos and seller's rating, agrees to take the risk and will not transfer any responsibility to ZenMarket for purchases of items of the User's choice from sellers of the User's choice (including but not limited to cases of fraud, items not as described, counterfeit items).
- the User knows they cannot cancel the bid, return the items, cancel auctions won.
- the User knows they are obliged to pay for the auctions won (including domestic shipping and other fees) and will not ask for refund from ZenMarket no matter the reason.
- the User is not buying illegal items;
- the User is not buying explosive, flammable, alcohol containing goods or other prohibited items including but not limited to sprays, grease, nail polish, perfumes, engine parts.
- the User is not buying oversized goods that exceed post limits.
- the User is not buying goods which they are unable to cover international shipping for.

19) By placing a bid, the User agrees to respect :
